Terms of Service
§ 1. General Provisions
- These Terms of Service define the rules for using the website available at cosphub.com, hereinafter referred to as the "Portal" or "CospHub".
- The owner and administrator of the Portal is Damian Górski, hereinafter referred to as the "Administrator".
- The Portal is non-profit and serves to build a community of people interested in cosplay.
- Using the Portal signifies acceptance of these Terms of Service in their entirety. A person who does not accept the Terms of Service should not use the Portal.
- The Administrator reserves the right to change the Terms of Service. Users will be informed of significant changes with appropriate notice via the Portal. Continued use of the Portal after the introduction of changes signifies their acceptance.
§ 2. Definitions
- Portal/Service – the CospHub website available at cosphub.com, encompassing all its functionalities.
- User – any person using the Portal.
- Registered User – a person who has created an Account on the Portal by choosing one of the roles: Enthusiast, Cosplayer, Photographer, Designer, Cospmaker, Wigmaker, Makeup, Event Organizer.
- User Content (Content) – any material (photo, video, text, description) added to the Portal by a Registered User.
- Account – an individual User profile created as a result of registration.
§ 3. Terms of Use and Registration
- Using the Portal in a way that does not require logging in (browsing public content) is available to everyone.
- Using functions that require logging in (adding content, sending messages, rating) is possible only after creating an Account.
- The service is intended for persons who have reached the age of 13. Persons aged 13-18 may register an Account only with the consent of parents or legal guardians. The Administrator may request confirmation of this consent.
- Registration is done by providing the required data and accepting the Terms of Service and Privacy Policy.
- It is prohibited to provide data of other persons, fictitious data, or misleading data.
- User profiles are public by default.
§ 4. Content Publication Rules (Content Policy)
A. General User Obligations:
- The User declares that they possess all necessary rights (including copyrights, image rights) to the Content they publish and that its publication does not infringe on the rights of third parties or applicable law.
- The User is obliged to accurately label published cosplay works. In particular, in the designated fields, they should indicate the source character/universe and, if possible, the authors co-creating the work (photographer, assistants, etc.).
- It is prohibited to publish cosplay Content whose authors are not the User or the team of which the User is a member (theft of someone else's work).
B. Prohibited Content and Marking System:
- It is prohibited to publish Content on the Portal that:
- Is unlawful, violates good morals, or the principles of the cosplay community.
- Is an advertisement or direct promotion of competing portals or social networking sites of a similar nature.
- Constitutes hate speech, is discriminatory, incites violence, or offends other persons.
- Is a manifestation of harassment, stalking, or violation of other persons' privacy.
- Is spam (mass, unwanted messages, comments).
- Rules regarding NSFW (Not Safe For Work) content:
- Content depicting cosplay with increased body exposure (e.g., bikini cosplay, revealing outfits) must be marked by the publisher with a special flag/option "18+".
- Content marked as "18+" is by default blurred or hidden from:
- Logged-out Users.
- Logged-in Users who have not confirmed they are 18 years of age.
- Viewing the full content requires age confirmation in the profile. The Administrator is not responsible for false age declarations.
§ 5. Copyright and Licenses
- The User retains full copyright to their Content. By publishing Content on the Portal, the User grants the Administrator a non-exclusive, free-of-charge, worldwide license for the duration of the Portal's existence, to the extent necessary for its display, sharing, reproduction (for technical purposes), and promotion of the Portal.
- This license allows the Portal to function but does not authorize the Administrator to sell, commercially license, or resell individual Users' Content to third parties.
- The User has the right to delete their Content at any time, which results in the termination of the granted license for that Content.
§ 6. Liability and Moderation
- The Administrator is a hosting service provider within the meaning of the law. They are not liable for content added by Users, provided that immediate action is taken upon receiving credible knowledge of its illegality.
- The User bears sole legal and civil liability for the Content they publish.
- The Administrator reserves the right to perform preventive and subsequent moderation of Content. In the event of a violation of the Terms of Service, the Administrator may, depending on the degree and severity of the violation:
- Issue a warning.
- Temporarily block access to the Account (e.g., for 7, 30 days).
- Permanently delete the Account (ban) along with all its content.
- Reporting mechanism: Violations of the Terms of Service can be reported to the Administrator at the e-mail address: [email protected]. The Administrator undertakes to review each justified report.
§ 7. Monetization, Advertisements, and Partnerships
- The Portal may display external advertisements and sponsored content (e.g., as part of cooperation with companies in the industry).
- The Administrator may launch a partner or affiliate program for active creators, the details of which will be specified in a separate document.
- The User may not use the Portal for the direct sale of their photos, posters, or other products in a way that bypasses the channels intended for this purpose (if such are created in the future). It is only permissible to provide links to external shops in the profile, provided this is not contrary to §4 sec. 1 point b.
§ 8. Personal Data and Privacy
- The administrator of Users' personal data is Damian Górski.
- Detailed rules for data processing are defined in a separate Privacy Policy, which is an integral part of the Terms of Service.
- The Portal does not process biometric data or special categories of data.
- The User may consent to receiving a newsletter.
- Upon deletion of the Account by the User, their personal data and Content are permanently deleted from the system within 30 days, unless legal provisions state otherwise.
§ 9. Final Provisions
- The Portal is non-profit. The Administrator is not liable for:
- Temporary interruptions in the Service's operation caused by technical factors or modernization.
- Loss of Content due to failure or force majeure.
- Damages resulting from the use or inability to use the Portal.
- In matters not regulated by the Terms of Service, the provisions of Polish law shall apply.
- Any disputes arising from the use of the Portal will be settled by the court having jurisdiction over the Administrator's registered office.
